These Terms & Conditions (“Terms”) govern your use of the services provided by TOUR2GETHER (PTY) LTD trading as Tour2gether (“Tour2gether”, “we”, “us” or “our”), a company registered in the Republic of South Africa with registration number 2025/645788/07 and its place of business in Cape Town, South Africa. By requesting a quote, making a booking or paying a deposit, you (“the Client”, “you” or “the Passenger”) confirm that you have read, understood and agreed to be bound by these Terms, our Cancellation & Refund Policy, and our Privacy Policy.

1. About Tour2gether

Tour2gether is a travel agency and tour broker based in Cape Town, South Africa. We curate, quote and book tour products supplied by third-party operators (“Suppliers”), including but not limited to coach tour operators (such as Europamundo Vacaciones S.A.U. and similar wholesale operators), hotels, transfer providers, excursion providers and visa agents. We act solely as an intermediary between you and those Suppliers. The tour you purchase is delivered by the relevant Supplier in accordance with that Supplier’s own terms and conditions, which you are deemed to have accepted when you confirm your booking.

2. Quotations & Bookings

2.1 Validity of quotes — Quotations are valid for three (3) calendar days from the date issued, unless stated otherwise in writing. Prices, availability and currency exchange rates are subject to change until a deposit has been received and the booking has been confirmed in writing by Tour2gether.

2.2 Confirmation of booking — A booking is only considered confirmed once: (a) we have received the non-refundable deposit in cleared funds; (b) we have received valid passport copies for all travelling passengers; and (c) we have issued a written booking confirmation or invoice.

2.3 Passenger information — You are responsible for ensuring that all names, dates of birth, passport numbers and other personal details provided to us exactly match the relevant passenger’s travel documents. Tour2gether is not liable for any loss, fees or denial of boarding resulting from incorrect or outdated information supplied by you.

3. Deposits, Payments & Pricing

3.1 Non-refundable deposit — A non-refundable deposit of R3,000 per person is required to secure every booking, plus any additional Supplier-specific deposit shown on your invoice. This deposit is NOT refundable under any circumstances once the booking has been confirmed — including, without limitation, in the case of a change of mind, a failed visa application, a failure to secure flights, medical reasons, or a Force Majeure Event. The deposit covers non-recoverable Supplier hold-costs and the administration work carried out by Tour2gether on your behalf. Tour2gether reserves the right to require an increased deposit (for example where a hotel, rail ticket, internal flight or excursion must be paid for in full at the time of booking) and such increased deposit, once invoiced, will be non-refundable to the extent that Tour2gether cannot recover it from the relevant Supplier.

3.2 Final balance and ticket issue — The full balance of the tour is due no later than seventy-five (75) days prior to departure. Tickets, vouchers and other travel documents are only issued after full payment has been received. Once full payment has been remitted to the relevant Supplier(s), most services become non-refundable from the Supplier’s side, irrespective of whether the tour has commenced.

3.3 Late payment — If the final balance is not received by the due date, Tour2gether is entitled to treat the booking as cancelled by you, in which case the cancellation fees set out in our Cancellation & Refund Policy will apply in full. Tour2gether is not obliged to send multiple reminders.

3.4 Payment method and banking details — All payments must be made by electronic funds transfer (EFT) into the bank account nominated by Tour2gether in writing on an official invoice. The only Tour2gether banking details are: First National Bank (FNB), Gold Business Account, account name TOUR2GETHER (PTY) LTD, account number 63172390527, branch code 204209 (Vineyard Road), SWIFT FIRNZAJJ. Tour2gether will NEVER change its banking details via email alone; if you receive any email purporting to change our banking details, please call us on +27 67 585 1110 to verify before transferring any funds. Bank charges and third-party payment-processing fees are for the Client’s account.

3.5 Pricing and currency fluctuations — Quoted prices are based on the exchange rates, taxes, tariffs, fuel levies and Supplier rates applicable at the time of quotation. Because most of our Suppliers are invoiced in Euro or US Dollar, Tour2gether reserves the right to adjust the Rand price of your tour prior to full payment to reflect any material change in these costs (including exchange-rate movements). You will be notified in writing of any such adjustment and will have the right to accept the revised price or cancel the booking (in which case the cancellation terms in clause 6 will apply).

4. Inclusions & Exclusions

Unless expressly stated in your written quotation and invoice, the price of your tour does NOT include:

  • International or domestic flights, airport taxes or flight-related insurance.
  • Visas, visa application fees or related courier, biometric or appointment fees.
  • Travel insurance (strongly recommended — see clause 7).
  • Meals, drinks, excursions or services not explicitly listed in the itinerary.
  • Tips, gratuities and personal expenses.
  • Costs arising from flight delays, missed connections or route changes.
  • Upgrades (room category, single supplements, optional excursions, extra nights).

5. Flights, Visas & Travel Documents

5.1 Flights — Tour2gether does not book or issue airline tickets. You are solely responsible for arranging your own flights. We strongly recommend that you do not book flights until you have received written confirmation from us that your tour is confirmed and operating.

5.2 Visas & entry requirements — It is your sole responsibility to ensure that you hold a valid passport (with at least six (6) months’ validity beyond your return date and sufficient blank pages), all required visas, and any other documentation required for entry into the countries on your itinerary. Tour2gether can, on request, refer you to a trusted third-party visa partner, but any agreement with such partner is between you and them. We accept no responsibility for refused or delayed visa applications, or for any costs incurred as a result.

5.3 Health requirements — You are responsible for satisfying any vaccination, health, medication or fitness requirements applicable to your destinations. You must disclose in writing any medical condition, mobility limitation or dietary requirement at the time of booking so that we can confirm suitability with the relevant Supplier.

6. Cancellations, Changes & Refunds

Cancellations, date changes, name changes and refund requests are governed by our Cancellation & Refund Policy, which forms an integral part of these Terms and is published on the Tour2gether website. By making a booking, you confirm that you have read and accepted that policy. In summary: the R3,000 per person deposit is non-refundable; cancellations inside 75 days of departure attract fees of 75% or more of the total tour cost; cancellations inside 30 days attract a 100% cancellation fee; and refunds are strictly limited to the amounts Tour2gether is able to recover from the relevant Supplier(s).

Tour2gether is pleased to offer a free date change where (a) the request is received in writing before the final balance is paid and no less than seventy-five (75) days before the original departure; (b) the new tour is the same tour at the same published price (in Euro or the original invoiced currency); and (c) the Supplier approves the change. Any difference in the Rand equivalent arising from exchange-rate movements between the original and new departure dates will be for the Client’s account, as will any fare difference, supplement or Supplier change fee where applicable.

7. Travel Insurance

Comprehensive travel insurance is strongly recommended and, for certain Suppliers or destinations, may be mandatory. Your insurance should cover (at minimum): medical and emergency evacuation; cancellation and curtailment; lost, stolen or delayed baggage; personal liability; and, where applicable, disruption caused by civil unrest, natural disasters or other force majeure events. A “cancel for any reason” extension is available from most insurers and is strongly recommended. Tour2gether is not liable for any loss or expense that would otherwise have been recoverable under an appropriate travel insurance policy.

8. Supplier Terms & Third-Party Services

Each tour, accommodation, transfer, excursion or visa service is supplied subject to the terms and conditions of the relevant Supplier. These may include additional cancellation penalties, minimum-numbers clauses, itinerary variation rights, complaint-handling procedures and liability limitations that apply in addition to these Terms. Where a Supplier’s terms are more restrictive than ours (for example, imposing a higher cancellation fee, an earlier final-payment date or stricter change rules), the more restrictive term will apply to the affected component of your booking. On request, we will make the relevant Supplier’s terms available to you in writing before you pay your deposit.

Because Tour2gether sources tour product from wholesale operators (including Europamundo), the Client acknowledges and agrees that any refund due is limited to the amount Tour2gether is actually able to recover from the relevant Supplier(s), less the non-refundable deposit and any non-recoverable Tour2gether administration fee. Tour2gether is under no obligation to pay any refund out of its own funds where the relevant Supplier has not refunded Tour2gether.

9. Itinerary Changes & Minimum Numbers

Tour departures may be subject to a minimum number of passengers. Suppliers reserve the right to alter itineraries, hotels, routes, vehicles, excursion order and inclusions where necessary due to operational, safety, weather, political or other circumstances beyond their reasonable control. Where a substantive change is made before departure, we will notify you as soon as reasonably possible and will, where available, offer a comparable alternative. Minor changes (such as a hotel of equivalent standard, or a reversal of the order of visits) do not entitle you to a refund.

10. Force Majeure & International Travel Risk

Neither Tour2gether nor any Supplier shall be liable for any failure to perform, or delay in performing, any obligation under your booking where such failure or delay is caused by a “Force Majeure Event”, which includes (without limitation): war, threat of war, civil unrest, terrorism, political instability, strikes, riots, sanctions, border closures, airspace closures, government travel advisories, pandemic or epidemic, quarantine restrictions, natural disasters, extreme weather, fuel shortages, fuel-price spikes, exchange-rate shocks, technical or mechanical failures of third-party providers, or any other event outside our reasonable control.

Clients are expressly made aware that international travel carries inherent risks, including the risk of sudden changes to the political, economic or security environment in any destination or transit country — for example, tensions or conflict in the Middle East or other regions. Such events, and their knock-on effects on fuel, airfares, insurance premiums or exchange rates, do NOT on their own entitle the Client to a refund from Tour2gether. Refunds in the case of a Force Majeure Event are strictly limited to the amounts actually recovered by Tour2gether from its Suppliers, less the non-refundable deposit and any non-recoverable Tour2gether administration fees. Clients are strongly encouraged to purchase travel insurance that covers Force Majeure cancellations and curtailments.

Where a tour is cancelled by the Supplier due to a Force Majeure Event, Tour2gether will, where reasonably possible, offer you (at your election) either (a) a credit or alternative tour of equivalent value (subject to any price or exchange-rate difference), or (b) a refund of the amounts actually recovered from the Supplier, less the non-refundable deposit and any administration fees.

11. Liability

Tour2gether acts as an intermediary between the Client and third-party Suppliers. To the maximum extent permitted by law, Tour2gether’s liability to the Client is limited to the Tour2gether booking/administration-fee element of the amount paid, and Tour2gether shall not be liable for: (a) any act, omission, insolvency or default of any Supplier or other third party; (b) any injury, illness, death, loss, damage, delay, inconvenience or expense caused by events outside our reasonable control (including any Force Majeure Event); or (c) any indirect or consequential loss, including loss of enjoyment, loss of earnings or loss of opportunity. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including any rights you may have under the South African Consumer Protection Act, 68 of 2008 (“CPA”).

12. Passenger Conduct

You agree to conduct yourself in a responsible manner and to comply with all reasonable instructions issued by Tour2gether, any Supplier, tour leader or driver. Tour2gether and any Supplier reserve the right to remove any passenger from a tour (at the passenger’s own cost and without refund) whose behaviour, in their reasonable opinion, poses a risk to themselves, to other passengers, to staff, or to the good order of the tour.

13. Complaints

If you have a complaint during your tour, you must raise it immediately with the tour leader or local Supplier representative so that it can be addressed in real time. Any complaint that cannot be resolved on the ground must be submitted to Tour2gether in writing at accounts@tour2gether.net within fourteen (14) days of the end of your tour, failing which your right to claim any compensation may be prejudiced.

14. Consumer Protection Act

Nothing in these Terms is intended to limit any right you may have under the Consumer Protection Act 68 of 2008. Where any provision of these Terms is found to be inconsistent with the CPA, that provision will be read down to the extent necessary to comply with the Act, and the remainder of the Terms will continue in full force and effect.

15. Personal Information & POPIA

Our collection and use of your personal information is governed by our Privacy Policy, which is aligned with the Protection of Personal Information Act, 4 of 2013 (“POPIA”). By making a booking, you consent to Tour2gether sharing your personal information with Suppliers, visa partners and other third parties strictly for the purpose of fulfilling your booking.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. The parties consent to the non-exclusive jurisdiction of the Magistrates’ Court having jurisdiction over the Client’s residential or business address, notwithstanding that the value of any claim may exceed the monetary jurisdiction of that court. Before any litigation is commenced, the parties agree to attempt to resolve any dispute through good-faith negotiation, and thereafter, if still unresolved, through mediation or the dispute-resolution procedures of the relevant consumer ombud (such as the Tourism Business Council of South Africa, where applicable) or the National Consumer Commission.

17. Changes to these Terms

Tour2gether may update these Terms from time to time. The version in force at the date you pay your deposit will apply to that booking. The latest version is always published on our website.

18. Entire Agreement

These Terms, together with the Cancellation & Refund Policy, the Privacy Policy, and any written quotation, invoice or confirmation issued to you by Tour2gether, constitute the entire agreement between you and Tour2gether in relation to your booking, and supersede any prior verbal representations, understandings or arrangements.
